1. Acceptance of Terms

By downloading, installing, or using ProbaBaby ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and ProbaBaby. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting in the App.

2. Service Description

ProbaBaby is a pregnancy, baby development, and parenting companion application designed for entertainment and educational purposes. ProbaBaby is NOT a substitute for professional medical care. Always consult qualified healthcare providers for medical decisions. See our Health & Safety Information page for detailed disclaimers.

• Prediction Features (Paid): AI-powered baby photo generation, genetic trait predictions (eye color, hair color, skin tone, height, blood type), multiple prediction modes, and PDF reports with genetic analysis.
• Pregnancy Tools (Free): Due date and gestational age calculator, ovulation and fertility window calculator, contraction timer, kick counter, and week-by-week pregnancy education content.
• Postpartum & Baby Tools (Free): Baby growth tracking using WHO growth standards, developmental milestone tracking, vaccination schedule information for 241 countries and territories, and vaccine regulatory approval reference.
• Maternal Wellness Tools (Free): Mood and emotional check-in tracking, EPDS self-screening, postpartum recovery timeline guidance, and support resource directories.
• Safety & Emergency Features (Free): Emergency birth reference guide, emergency contact directories for 241 countries, and early birth risk awareness information.
• Entertainment Features (Free): Mayan Gender Prediction, Chinese Gender Calendar, and Baby Zodiac profiles — all traditional and for fun.

3. User Responsibilities

• Provide accurate information about yourself
• Only upload photos you have the right to use
• Not upload photos of minors without parental consent
• Not use the App for any illegal or unauthorized purpose
• Not attempt to reverse engineer or hack the App
• Not share your account credentials with others
• Consult qualified healthcare professionals before making any health-related decisions based on information from this app

4. Credits & Payments

• Photo Only Mode: 4 credits
• Basic Genetics Mode: 8 credits
• Advanced Genetics Mode: 12 credits
• Scientific Mode (Genetics Only): 4 credits
• Free Features: Eye Color Predictor, Blood Type Calculator, Height Estimator, Ovulation Calculator, BMI Calculator, and Due Date Calculator are available free of charge.
• Purchases: All purchases are processed through the Apple App Store. Prices are displayed in your local currency. All sales are final once credits are used. Unused credits remain valid indefinitely.
• Refunds: Unused credits may be refunded within 14 days of purchase. Refunds are processed through the App Store. Used credits cannot be refunded.

5. Intellectual Property

ProbaBaby owns all rights to the App, including design, code, and algorithms. You retain ownership of photos you upload. AI-generated baby images are licensed to you for personal, non-commercial use. You may save and share predictions with family and friends and print them for personal use. You may NOT sell or commercially distribute generated images, use predictions for advertising without permission, or claim AI-generated images as photographs of real people.

6. Important Disclaimers

ProbaBaby and all its features are provided "as is" for entertainment and educational purposes only. Nothing in this App constitutes medical advice, clinical diagnosis, genetic counseling, or professional health guidance.

• AI Predictions & Genetic Traits: Baby photo predictions and genetic trait calculations are based on statistical probability models and AI image generation. They are artistic interpretations and probabilistic estimates, not actual genetic testing.
• Health Information: Information about pregnancy symptoms, postpartum recovery, nutrition, and exercise is provided for general educational awareness only. Always follow your healthcare provider's personalized guidance.
• Vaccination Information: Vaccination schedules and safety information are compiled from publicly available sources including the WHO, CDC, EMA, and FDA. Your pediatrician's recommendations always take precedence.
• Growth & Development Data: Growth charts are based on WHO Child Growth Standards and are provided for reference only. Only your child's healthcare provider can properly assess your child's growth and development.
• Mental Health Screening: The EPDS is a validated screening questionnaire included for awareness purposes. Results in this App are NOT a clinical diagnosis. If you are in crisis, contact emergency services or a crisis helpline immediately.
• Emergency Features: The emergency birth guide is a general reference. It is NOT a substitute for professional emergency medical assistance. Always call emergency services first.
• Fertility & Conception: Ovulation calculators and fertile window estimates are based on statistical averages. They should not be relied upon as a method of contraception or as a guarantee of conception timing.
• Fun & Entertainment Predictions: Mayan Gender Prediction, Chinese Gender Calendar, and Zodiac predictions are based on traditional cultural beliefs and folklore. They have no scientific basis and are included purely for entertainment.
• Data Accuracy: While we strive to keep all information current and accurate, we do not warrant that any information in the App is complete, reliable, or error-free.

7. Limitation of Liability

To the maximum extent permitted by law, ProbaBaby and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or emotional distress. Our total liability for any claims shall not exceed the amount you paid for credits in the past 12 months. Some jurisdictions do not allow limitations of liability, so some of these limitations may not apply to you.

8. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our data practices as described in the Privacy Policy.

9. Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, abuse the App or other users, or upload prohibited content. Upon termination, your right to use the App ceases immediately. Unused credits may be forfeited upon termination for cause.

10. Prohibited Content

• Content that is illegal or promotes illegal activities
• Nudity or sexually explicit material
• Content that depicts or promotes violence
• Content that infringes on intellectual property rights
• Malware or harmful code
• Content that harasses, threatens, or defames others
• Fraudulent or deceptive content

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law.

12. Changes to Terms

We may update these Terms from time to time. Changes will be effective immediately upon posting in the App. Continued use of the App after changes constitutes acceptance of the new Terms. We will make reasonable efforts to notify users of significant changes through in-app notifications or email.

13. Health Feature Specific Terms

By using health-related features of ProbaBaby (including vaccination tracking, growth monitoring, and health data logging), you acknowledge and agree that:

• All health information is provided for general informational and educational purposes only
• The app is not a substitute for professional medical advice, diagnosis, or treatment
• You should always seek the advice of your physician or other qualified health provider
• You assume full responsibility for decisions made based on information provided by the app
• We are not liable for any health outcomes resulting from use of these features
• Health data you enter may be used in aggregated, anonymized form to improve product features — never for AI model training or advertising
• You will keep your health data accurate and up to date
• Emergency situations require immediate medical attention — do not rely solely on the app

14. Regional Data & International Use

ProbaBaby provides data for 241 countries and territories. Regional information including vaccination schedules, healthcare systems, and medical guidelines are compiled from official sources and updated regularly. However:

• Information accuracy depends on official source availability and updates
• You are responsible for verifying information with local healthcare providers
• Medical practices and requirements vary by region — always follow local medical guidance
• We strive for accuracy but cannot guarantee completeness of all regional data
• Some features may not be available or may function differently in certain regions
